NAR Introduces New MLS Policy – OneKey® MLS Decisioning Update to Follow

The National Association of REALTORS® (NAR) has announced a new MLS policy, “Multiple Listing Options for Sellers,” aimed at expanding consumer choice while maintaining fair housing principles. This policy will complement the existing Clear Cooperation Policy (CCP) and provide sellers with more flexibility in marketing their properties.

Key highlights:

  • The new policy doesn’t change CCP and its requirement to submit a listing with the MLS within one business day of public marketing.
  • Sellers can opt for a “delayed marketing exempt listing,” allowing them to delay public marketing through Internet Data Exchange (“IDX”)  and syndication while still making the listing available to MLS Participants.
  • Each MLS will determine the delayed marketing period suitable for its local market.
  • Seller-signed disclosures will be required for delayed marketing and office exclusive exempt listings.
  • One-to-one communication about listings from the listing broker to another broker will not trigger CCP, but  multi-brokerage communications about a listing will still constitute public marketing that triggers CCP and its requirement to submit a listing with the MLS within one business day. 

This policy takes effect on March 25, 2025, with implementation required by September 30, 2025. OneKey® MLS is currently reviewing the policy and will provide a subsequent update on how and when it plans on implementing the changes.
